Who is responsible for processing your personal data?

ALLQUANTO DIGITAL, S.L., with Tax ID number B-42655886, registered office at C/ PORTUGAL No 39 5 D, C.P- 03003- ALICANTE, phone number 602-632-959, and email: tiago.raffo@allquanto.com, is responsible for processing your personal data. Therefore, we guarantee its security and confidential treatment, in accordance with the provisions of the EUROPEAN DATA PROTECTION REGULATION (EU) 679/2016, as well as any other applicable regulations.

What types and categories of personal data do we process?

The categories of data we will need from you are classified as:

• Identification and contact data.
• Billing
• Connection and navigation data.

Within each of these data categories are the following types of data that we will request from you or that you will provide to us at some point in our relationship:

Identification and contact data: Name and surname, postal address, shipping address, date of birth, telephone number, and email address. You may provide us with data of third parties with whom you have some type of relationship. In that case, we will process the data because we understand that you have notified these third parties that you were going to provide us with their data and have referred them to this privacy policy so they know how we process their data. However, when we have the opportunity, we will inform them of this privacy policy.

Billing and payment data: Billing address. Data necessary to create and complete an invoice; for Companies, in compliance with tax obligations, it is mandatory to have a Tax ID Number to complete the invoice. Payment or card data is not stored or collected in our systems; instead, the data is sent directly through the payment gateway to the payment service provider.

Connection and navigation data: In case we use this type of data, we may have access to your device’s IP address, device identification code, and metadata.

For Companies, we will process your company name and tax identification number, name and surname of the contact person, address, and telephone number.

We appreciate that the data you provide is up-to-date and accurate. If the data you provide is false, incomplete, inaccurate, or not up-to-date, we reserve the right to terminate the contracted services or any other contract that may have been signed.

For what purposes do we use your personal data?

At ALLQUANTO DIGITAL, S.L., we use your data to the extent permitted by the GDPR, as well as by the applicable current regulations. In any case, the processing will be done for specific, explicit, and legitimate purposes, and in no case will they be processed in a manner incompatible with these purposes. Specifically, the following processing will be carried out:

• Answer your inquiries, requests, or petitions.
• Manage the contractual relationship and the provision of consultation services

   requested by the client.
• Manage your phone calls.
• Issue payment receipts for services provided to the client.
• For the proper performance of the requested service, the client’s necessary personal

   data will be processed to monitor their evolution during the provision of the service.
• Carry out all administrative, fiscal, and accounting procedures necessary to comply

   with our contractual commitments and fiscal and accounting obligations.
• Comply with our legal obligations.
• Analyze and improve our services and communications with you.
• Monitor and evaluate compliance with our policies and standards.
• Manage sending of information and commercial prospecting by any means in case of

   explicit consent.

What is the legitimacy for processing your data?

The legitimacy of the personal data processing we carry out is done at all times in compliance with the provisions of Article 6 of the GDPR, as well as Article 8 of Organic Law 3/2018. In cases where the legitimacy for the main purpose of data use is not found in any of the above legal bases, the consent of the interested party will be requested for the processing.

How long do we keep your data?

Personal data will be kept for the time necessary for the provision of the service or as long as the interested party does not withdraw their consent. Subsequently, the data will be deleted in accordance with the provisions of data protection regulations, which implies their blocking, being available only at the request of Judges and courts, the Ombudsman, the Public Prosecutor’s Office, or the competent Public Administrations during the limitation period for actions that may arise and, after this period, they will be completely eliminated.

Who do we share your data with?

We inform you that the data provided will be communicated to the different suppliers of products and services that are necessary for the execution of the requested processing. Our suppliers are obliged to use the provided data solely and exclusively for the fulfillment of the requested service. The personal data processed by ALLQUANTO DIGITAL, S.L. to achieve the purposes detailed above may be communicated to the following recipients depending on the legal basis of the communication:

• Public Administrations in cases provided by Law.
• State Security Forces and Corps.
• Banks and financial entities for the collection of contracted services.
• Public records of asset solvency and fraud prevention systems.

International Transfers

Your personal data may be transferred to collaborators and service providers residing outside the European Union. We have signed Data Processor contracts with these collaborators and have verified that they comply with the necessary technical and organizational measures to guarantee the protection of your personal data in accordance with the GDPR.  

International data transfers are only made to countries that offer an adequate level of data protection or to entities that have provided adequate guarantees, such as the standard contractual clauses adopted by the European Commission.

What are your rights?

Rights:

 In particular, regardless of the purpose or legal basis under which we process your data, you have the right to:

• Right of access:  any person has the right to obtain confirmation as to whether

   ALLQUANTO DIGITAL, S.L. is processing personal data concerning them.

• Right of rectification: You have the right to access your personal data that we have

   and request its rectification when it is inaccurate.

• Right of erasure: when the collected data is no longer necessary for the purposes for

   which it was collected.

• Right to restriction of processing: you may request the limitation of the processing of

   your data and request that it be kept for the exercise or defense of claims.

• Right to data portability: you have the right to obtain the personal data concerning  

  you in a structured, commonly used and machine-readable format and to transmit it

   to another controller.

• Right to withdraw consent: the right to withdraw any consent you have previously given us to handle your personal information. If you withdraw your consent, this will not affect the lawfulness of the use we gave to your personal information before you withdrew your consent.

How can you exercise your rights?

ALLQUANTO DIGITAL, S.L. is committed to respecting the confidentiality of your personal data and guaranteeing the exercise of your rights. You can exercise them at no cost by writing an email to our address tiago.raffo@allquanto.com simply indicating the reason for your request and the right you want to exercise, informing you that it is essential, by law, that you provide a copy of your ID or NIE. We also inform you that, following our transparency policy, you can request the forms for rights by any of the following means: at the headquarters itself or by email. You are informed that you can also exercise your rights by submitting a declaration to the competent control authority, when you have not obtained satisfaction in the exercise of your rights.

Do you want a form for the exercise of Rights?

• We have forms for the exercise of your rights, ask us for them by email or, if you

   prefer, you can use those prepared by the Spanish Data Protection Agency or third

   parties.
• These forms must be electronically signed or accompanied by a photocopy of your

   ID.
• If someone represents you, you must attach a copy of their ID, or have them sign it

   with their electronic signature.
• The forms can be submitted in person, sent by letter or by email to the address of

   the Controller at the beginning of this text.
